1. Who we are and when these terms apply
- CRIVIX is offered by CRIVIX (in oprichting), Christiaan Deniz (hereinafter: CRIVIX or we). Address and Chamber of Commerce number follow upon registration before the paid period. You can reach us at support@crivix.app.
- These terms apply to every use of the CRIVIX website and app and to every agreement between you and CRIVIX. You accept them when creating your account with a checkbox that is not pre-ticked. We record the version and the time of your acceptance. If you already have an account, we ask you to accept the then current version at your next visit.
- In addition to these terms, our subscription, withdrawal and cancellation terms apply to CRIVIX Premium. How we handle your data is described in our privacy policy and our cookie policy; we do not ask for acceptance of those documents, because they describe what we do and what your rights are.
- CRIVIX is intended for consumers who live in the Netherlands. We do not currently target other countries.
2. What CRIVIX is, and what CRIVIX is not
- CRIVIX is an online training planner for football players. Based on what you enter (your football week, your goal, your training days, your location and equipment), CRIVIX proposes a training week and individual sessions, adapts them to your feedback and tracks your development. We currently use your position for tips, not yet for choosing exercises.
- CRIVIX composes part of the sessions with the help of an AI service. Which data is used for that is described in section 5 of the privacy policy. A composed session is always a proposal: you can change, move or skip it.
- CRIVIX is not a medical device and gives no medical advice. The sessions are general training proposals based on your own input. They are not tailored to your medical situation and do not replace a doctor, physiotherapist or coach.
- We do not guarantee sporting results. Whether you improve depends on many factors outside CRIVIX.
- CRIVIX is currently available by invitation, because we are putting the finishing touches to the product. You cannot create an account without an invitation. What that means for the exercises and for your own responsibility is set out in section 5.7.
3. Account and access
- An account is personal. You create at most one account and you only use your own account.
- You sign in with a one-time code that we send to your e-mail address. Keep your e-mail account secure and do not share a code with anyone. Everything that happens through your account is for your account, unless you can show that it is not attributable to you. If you suspect misuse, report it immediately via support@crivix.app; in Settings you can also sign out on all your other devices.
- You provide accurate and complete information and keep it up to date. This applies in particular to your date of birth, your football week and the information on which CRIVIX bases your sessions.
- We may temporarily restrict your access where necessary for the security of your account or of CRIVIX, for example where we suspect misuse. We will inform you if so.
4. Age
- The current invitation period is only for outfield players aged 18 and over. There is no goalkeeper training yet.
- We only invite players who meet that condition.
- We check your age once using your date of birth. If it shows that you are under 18, you cannot take part and you can delete your account immediately.
5. Sport, health and safety
- Sport involves risks, such as injuries and overload. You decide for yourself whether you are fit enough to train and you train within your own limits. If you are in any doubt about whether you are healthy enough to exercise, for example because of an injury, a condition or medication, consult a doctor first.
- Stop if you feel pain. If you have any doubts about your health, consult a doctor. You see this notice before your first physical session and you confirm that you have read it. We record that confirmation.
- You arrange a suitable and safe training location, sound equipment, appropriate clothing and footwear, a warm-up and sufficient rest and fluids. You follow the instructions for an exercise and you adapt or skip an exercise if it does not feel right.
- During a session the button "Pain or complaints?" is always available. If you feel pain, stop the exercise or the session. If the pain persists, consult a doctor or physiotherapist.
- The Check-in (questions about pain, sleep and energy) is optional and requires separate consent. Without the Check-in, CRIVIX does not adapt your session to how you feel; you then adapt or skip your session yourself if you do not feel well.
- We make no medical, performance or injury-prevention claims. A session, an adaptation or a safety advice in the app is never a medical assessment of your situation.
- During the invitation period, the exercises, their doses (such as the number of repetitions, the duration, the rest and the intensity) and the rules by which CRIVIX combines them into sessions have not yet been reviewed by an external, qualified professional, such as a physiotherapist or a qualified coach. That review will take place before CRIVIX becomes available to everyone. During this period you therefore train on your own responsibility. You listen to your body, adapt or skip an exercise if it does not feel right, and stop immediately if you feel pain or are in doubt. You do not train if you are injured or ill. If you are in any doubt about your health or about what your body can handle, consult a doctor or physiotherapist first. We also point this out to you in the safety notice before your first physical session (section 5.2). What this means for our liability is set out in section 13.3.
6. Usage rules
You use CRIVIX only for your own training and in accordance with the law and these terms. You may not:
- misuse, disrupt or overload the service, or circumvent or test its security without our written permission;
- use someone else's account, or give your account to someone else;
- collect data or content from CRIVIX by automated means (scraping), decompile or copy the software, or copy or distribute CRIVIX's exercises, texts and media beyond your own use;
- enter other people's data, unlawful content or content that harms others in free-text fields; free-text fields are meant for short football notes, not for medical details;
- use CRIVIX commercially, for example to train others, without our written permission.
If you break these rules, we may restrict your access or end your account (section 9). We warn you first and give you the opportunity to respond, unless the breach is serious or immediate action is needed for the safety of others or of CRIVIX.
8. Right of withdrawal
If you, as a consumer, conclude a distance contract with us, you have a 14-day cooling-off period in which you can withdraw from the contract without giving reasons. This also applies to your free Premium. How that works, and what the consequences are, is set out in section 5 of the subscription, withdrawal and cancellation terms.
9. Term, cancellation and termination
- The agreement for your account is for an indefinite period. You can end it at any time by deleting your account in Settings → Account. Your data is then deleted in accordance with the privacy policy.
- Want to stop your free Premium without deleting your account? E-mail support@crivix.app. See the subscription terms.
- We may terminate the agreement with one month's notice, for example if we discontinue CRIVIX or part of it. We refund any amount prepaid for the period after termination.
- We may end or restrict your access immediately if: you seriously or repeatedly breach these terms; you act fraudulently or provide incorrect information that matters for safety or for the agreement; the law or a competent authority requires us to; or a serious safety report makes it necessary. We will tell you why.
- We may end the invitation period with at least 14 days' notice. Your account and your data then remain. If we offer a paid subscription at that time, you explicitly choose it yourself, or not (section 7.3). Without that choice, only your Premium access ends.
- After termination you can still download your data for at least 30 days, unless you deleted your account yourself.
10. Operation, maintenance and changes to CRIVIX
- We supply CRIVIX as the law requires of us: the service conforms to the agreement and we keep it working, secure and up to date for the duration (Book 7, Title 1AA of the Dutch Civil Code). Your statutory rights as a consumer remain fully intact.
- CRIVIX is an online service. We aim for the highest possible availability, but cannot guarantee that CRIVIX always and everywhere works without errors. Where possible we announce maintenance in advance and schedule it outside the busiest hours. An active session remains usable without a connection, as far as the app technically supports that.
- We may change CRIVIX, also beyond what is necessary to keep the service in conformity with the agreement, but only for one of these valid reasons: adding new or improved exercises, functions or training logic; adapting the service to a new technical environment (such as new browsers, devices or standards) or to a larger number of users; improving security or the safety of training; fixing errors; complying with the law, a court decision or an instruction from a competent authority; or another important operational reason, such as switching a supplier. A change costs you nothing extra, and we inform you about it clearly and comprehensibly.
- If a change negatively affects your access to or use of CRIVIX to more than a minor extent, we inform you reasonably in advance by e-mail (a durable medium) of the features and time of the change and of your right to terminate the agreement. You may then terminate the agreement free of charge within 30 days of receiving that information or, if that is later, within 30 days of the moment the change was made (Article 7:50al of the Dutch Civil Code). We refund any amount prepaid for the period after termination.
- We may discontinue CRIVIX. The notice period of section 9.3 then applies and you can download your data until the end date and for at least 30 days after it.
11. Intellectual property and your content
- All rights in CRIVIX, including the software, the exercises, the texts, the images, the videos and the brand identity, belong to CRIVIX or our licensors. You receive a personal, non-transferable right to use CRIVIX for your own training for as long as the agreement lasts.
- What you enter yourself (such as your notes and reflections) remains yours. You grant us the right to use that content as far as necessary to deliver CRIVIX to you, secure it and improve it, as described in the privacy policy. You warrant that you are allowed to enter that content.
12. Privacy
How we handle your personal data, which data we keep and for how long, and which rights you have, is set out in our privacy policy. We process health data only with your separate, explicit consent; if you withdraw it, we delete your health data immediately.
13. Liability
- We are liable for damage in accordance with the law, for example where it results from a shortcoming attributable to us. These terms do not limit or exclude our statutory liability, except for the limitation in section 13.3.
- If the damage is partly the result of a circumstance attributable to you, the statutory rule on contributory fault applies (Article 6:101 of the Dutch Civil Code): the damage is then apportioned according to the extent to which each party's circumstances contributed to it, unless fairness requires a different apportionment. That is one more reason to follow the safety rules in section 5, to stop if you feel pain and to provide accurate information.
- During the invitation period you train on your own responsibility (section 5.7). To the extent permitted by law, we are not liable for damage resulting from the fact that the exercises and their doses have not yet been reviewed by an external professional during that period. This limitation does not apply to damage resulting from intent or gross negligence on our part or on the part of our managerial staff, and it does not affect the rights you have as a consumer under mandatory law.
- Your statutory rights as a consumer, including your rights where a digital service does not conform to the agreement (Book 7, Title 1AA of the Dutch Civil Code), remain fully intact.
- If you have suffered damage for which you want to hold us liable, let us know via support@crivix.app. We ask you to do so as soon as reasonably possible, so that we can investigate the damage and help prevent further damage. This is a request, not a condition we attach to your rights.
14. Force majeure
We are not required to perform our obligations for as long as we are unable to do so due to a circumstance not attributable to us, such as an outage at a supplier of hosting, database, payment, e-mail or AI, an internet or power failure, a cyber attack, or a government measure. If such a situation lasts longer than 30 days, either of us may terminate the agreement; we refund any amount prepaid for the period after that.
15. Complaints, applicable law and disputes
- Do you have a complaint about CRIVIX? E-mail support@crivix.app. We usually respond within 1 to 2 working days and in any case give a substantive response within 14 days. If that is not possible, we will tell you when you can expect a response.
- These terms and every agreement with CRIVIX are governed by Dutch law. If you live in another country of the European Union, you keep the protection of the mandatory rules of your own country.
- Disputes are submitted to the Dutch court that has jurisdiction by law. We are not affiliated with a disputes committee.
16. Language
These terms were drawn up in Dutch and translated into English. In case of any difference between the versions, the Dutch version prevails.
17. Changes to these terms
- We may change these terms, for example when CRIVIX gains new functions, when the law changes or to remove ambiguities. Every version has a version number and an effective date.
- We announce a change that matters to you at least 30 days before the effective date by e-mail or in the app, and we ask you to accept it again. If you do not accept the new version, you may terminate the agreement free of charge until the effective date; we refund any amount prepaid for the period after that.
- Earlier versions remain available on this page. In Settings → Privacy and data you can see which version you accepted and when.
18. Other provisions
- If a provision of these terms is invalid, the other provisions remain in force. We replace the invalid provision with a valid provision that comes as close as possible to its intent.
- We may transfer our rights and obligations under the agreement to another company as part of a transfer of the CRIVIX business. We will inform you of this. Your rights under the agreement and the privacy policy remain unchanged.
- These terms, the subscription terms and the documents they refer to together form the entire agreement between you and CRIVIX.
